The U.S. Department of Justice sued the Maryland Department of State Police (MDSP) on October 2, 2024, accusing the agency of violating Title VII of the Civil Rights Act of 1964. The lawsuit alleges MDSP used a physical fitness test and written exam that disproportionately disqualified African-American and female applicants, despite the tests not being proven job-related. Title VII prohibits employment practices that unintentionally discriminate against individuals based on race or sex unless such practices are essential for the job.

MDSP denies the allegations but has agreed to settle the case through a consent decree. Both parties aim to resolve the lawsuit with measures ensuring compliance with federal anti-discrimination laws. The settlement, provisionally approved by the court on November 8, 2024, awaits final approval after a Fairness Hearing scheduled for March 10, 2025.

Terms of the Consent Decree

The settlement requires MDSP to stop using the contested hiring tests and to ensure future tests are lawful and validated for job relevance. Additional provisions include:

  • Monetary Awards: Compensation will be provided to eligible African-American and female applicants who were adversely affected by the hiring process.
  • Priority Hiring: Affected applicants who would have qualified as troopers under lawful hiring standards will receive priority consideration for employment.

Fairness Hearing and Public Input

The court will consider objections to the consent decree at the Fairness Hearing on March 10, 2025. Members of the public or affected individuals who oppose the settlement may file objections if they believe the terms are unfair, unreasonable, unlawful, or against the public interest.

An objection form will be made available on the settlement website in mid-to-late December 2024. All objections must be submitted by January 20, 2025. Individuals who do not submit objections by the deadline may lose the right to challenge the settlement in the future.

Next Steps for Eligible Applicants

If the court grants final approval, MDSP will notify individuals who may qualify for monetary or priority hiring awards. Eligible parties will then have the opportunity to submit a claim form to receive their award.

Those who do not wish to object to the settlement need not take further action at this time.
