The school system operates under federal and state laws but emphasizes that it does not inquire about a student’s or family member’s immigration status.

CCPS provides clear guidance for administrators and staff to address immigration-related matters, ensuring consistent practices across the school system. This guidance is regularly reviewed and strictly adhered to, particularly in cases where law enforcement visits a CCPS facility. Under the Family Educational Rights and Privacy Act (FERPA), CCPS cannot release student records without parental consent unless a court order or subpoena is presented.

Student Rights and Key Guidelines

1. Access to Public Education
Every child is entitled to a free public education, regardless of their or their parent/guardian’s immigration status.

2. Emergency Contact Updates

  • Parents/guardians should regularly update emergency contact information for their child.
  • Updates can be made in person or through the email address on file with CCPS. School principals can provide guidance on which staff member should receive the email.
  • Students can only be released to individuals listed as emergency contacts in the CCPS student information system, Synergy.

3. Care and Custody Plans

  • Parents/guardians are encouraged to create a care and custody plan for their child to address potential emergencies, such as arrest, detention, or hospitalization.
  • Designate a trusted family member or adult as an emergency contact who is familiar with the plan.
  • Parents/guardians may also appoint a “standby guardian” to care for their child and make decisions on their behalf during emergencies. This can be formalized using the Maryland Judiciary Form, which should be shared with the child’s school, healthcare providers, and relevant family members.

4. Enrollment Requirements

  • Proof of residency is required to confirm a student’s enrollment zone, but information about citizenship or immigration status is not requested.
  • Social Security numbers are neither collected nor required by CCPS.

5. Protection of Student Information

  • Education records and personal information are protected under federal and state laws. CCPS requires written parent/guardian consent to release information unless authorized by law or in response to a court order or subpoena.

6. Reporting Bullying, Harassment, or Discrimination

  • Students, parents, or staff can report incidents of bullying, harassment, or discrimination using forms found in the CCPS Code of Student Conduct. Additional copies are available upon request from school staff.
  • Reports can also be submitted anonymously through the online “See Something, Say Something” tool available at www.ccboe.com.
